Opticomm warrants its products to be free from defects in materials and workmanship for a period of ten (10) years from the date of delivery. Opticomm will replace or repair at its option any equipment it judges to be defective provided:
Before any equipment is returned to Opticomm for repair or replacement, a Returned Material Authorization (RMA) number must be obtained. Opticomm will pay return shipping expenses for the repaired equipment, including the cost of insurance provided the equipment proves to be defective and is within the limits of the warranty. Otherwise, the buyer is liable for all handling, shipping and insurance costs. After the equipment has been repaired, Opticomm will reinstate the remainder of the warranty period for the repaired equipment. The warranty does not cover defects resulting from accidents, alteration, failure to follow instructions, misuse, fire, flood, and acts of God. If repairs or modifications are made by persons other than Opticomm's authorized service personnel without written consent, Opticomm shall be released from all obligations under its warranty. Opticomm shall have no liability or responsibility to the customer or any other person or entity with respect to any liability, personal injury, death, or loss caused or alleged to be caused directly or indirectly by products and equipment sold by Opticomm, also including, but not limited to, any interruption of service, loss of business or anticipatory profits or consequential damages resulting from the use or operation of any such products or equipment. It is the responsibility of the buyer to determine the suitability of the product for the intended use. Opticomm's aggregate liability, including for breach of warranty, under any contract or otherwise, shall not exceed the purchase price of the specific product shipped and against which a claim is made. In no event shall the liability of Opticomm arising in the connection with any products or equipment sold, regardless of the type of claim, exceed the amounts paid by the buyer to Opticomm for the equipment involved. This warranty is in lieu of all other warranties, expressed or implied. No representative or person is authorized to represent or assume for Opticomm any liablity with respect to the sale of Opticomm products or equipment. The provisions of this warranty are subject to change by Opticomm and may differ from those which apply to the actual sale of any product or equipment by Opticomm. Upon the purchase of any product, the applicable terms of warranty will be available to the purchaser upon request. For repairs outside of warranty service or after the warranty period, charges will be in accordance with prevailing authorized repair prices. Product maintenance agreements and other customer assistance arrangements may be available for Opticomm products and should be raised with your Opticomm sales representative.
